A

Abogado

Lawyer

An independent lawyer who checks the legal status of the property, reviews contracts and protects the buyer’s interests during the purchase.

Why this matters

The notary acts impartially and does not replace your own lawyer. Independent legal advice can reveal debts, planning issues and contract risks before you commit.

Acta de Titularidad Real

Beneficial ownership declaration

A formal declaration identifying the natural person who ultimately owns or controls a company involved in a transaction. A notary may require it when a company buys or sells property.

Why this matters

Company structures do not remove identification and anti-money-laundering checks. The correct company documents should be prepared before completion.

Administrador de Fincas

Community property manager

The professional appointed to administer a community of owners, including budgets, meetings, contractors, records and collection of community fees.

Why this matters

The administrator can provide important information about debts, approved works, disputes and community rules, but your lawyer should independently review the documents.

AFO

Asimilado Fuera de Ordenación

A legal recognition that may apply in Andalusia to certain buildings created without the required planning permission, or contrary to planning rules, when legal enforcement is no longer possible. It does not make the building fully legal.

Why this matters

AFO status can affect finance, valuation, renovation, utilities and resale. Ask your lawyer to confirm exactly what is recognised and what restrictions remain.

AJD

Actos Jurídicos Documentados

Stamp duty that may apply to certain notarised documents, including many new-build purchases and mortgage deeds. The rate and who pays depend on the transaction and current law.

Why this matters

AJD can be a material buying cost. Request a transaction-specific tax calculation rather than relying on a general percentage.

Anejos

Annexes or appurtenant elements

Spaces legally linked to a main property, such as a parking place, storage room or terrace, as described in the title deed and Land Registry.

Why this matters

Confirm whether each advertised extra is registered as part of the home, a separate registered property, a communal element or merely an exclusive right of use.

Arras

Contrato de arras

A private deposit agreement used before completion. It normally records the price, deadline and conditions, but the legal consequences depend on the wording and type of arras agreed.

Why this matters

Do not assume every deposit is refundable or that the usual “double deposit” rule automatically applies. Have the agreement checked before signing or transferring money.

Aval Bancario

Bank guarantee

A guarantee issued by a bank to protect specified payments, commonly used for stage payments made during an off-plan purchase.

Why this matters

For an off-plan purchase, ensure every protected payment is covered by an individual guarantee or legally compliant insurance and understand how a claim would be made.

B

Boletín Eléctrico

Electrical installation certificate

A technical certificate confirming key details and compliance of an electrical installation. Its formal name is Certificado de Instalación Eléctrica.

Why this matters

It may be needed to activate, increase or change an electricity supply. An old or non-compliant installation can delay connection and require remedial work.

C

Cambio de Titularidad

Change of account holder

The process of transferring utility, community or service contracts into the new owner’s name after completion.

Why this matters

Arrange readings and retain proof of the transfer so the new owner is not confused with the former account holder or charged for the wrong consumption period.

Cancelación Registral

Registry cancellation

The formal removal of a repaid mortgage or other cancelled right from the Land Registry. Paying the final loan balance does not by itself erase the registered entry.

Why this matters

A mortgage can still appear as a charge after repayment. The seller should normally arrange for its economic and registry cancellation as agreed in the sale.

Cargas

Charges and encumbrances

Mortgages, attachments, easements, restrictions or other rights that may affect a property. Many registered charges appear in the Nota Simple.

Why this matters

Some debts or restrictions can remain attached to the property. Your lawyer should identify how each charge will be cancelled or accepted before completion.

Catastro

Catastro Inmobiliario

The administrative register describing a property for tax and mapping purposes. It records information such as location, use, surface area and cadastral value.

Why this matters

Cadastral information can differ from the Land Registry or physical reality. Differences should be investigated before purchase.

Certificado de Deuda Cero

Zero-balance mortgage certificate

A certificate from a lender confirming that a mortgage loan has been fully repaid. It supports the later notarial and registry cancellation process.

Why this matters

It proves the loan balance is zero, but the mortgage may remain visible at the Land Registry until the separate cancellation steps are completed.

Certificado de la Comunidad

Community debt certificate

A certificate stating whether the owner is up to date with payments owed to the community of owners, normally presented for the sale.

Why this matters

A buyer can become exposed to certain community debts attached to the property. Obtain a current certificate and review any approved extraordinary contributions.

Certificado Energético

Energy Performance Certificate

A certificate rating the energy efficiency of a property. It is generally required when a property is sold or rented, subject to limited exemptions.

Why this matters

The seller or landlord should be able to provide a valid certificate. The rating can also indicate likely energy performance and possible improvements.

Comunidad de Propietarios

Community of owners

The owners’ association responsible for shared elements and services in a building or residential development. Owners pay community fees and follow its statutes and approved rules.

Why this matters

Ask for the current fees, meeting minutes, budgets, planned works, restrictions and confirmation that the seller is up to date with payments.

Contrato de Compraventa

Private purchase contract

The private contract setting out the agreed sale terms before the public deed is signed. It may include conditions, completion dates, inventory and consequences of default.

Why this matters

Once signed, it can create binding obligations. Finance, legal checks and other important protections must be written into the contract where needed.

Coordenadas Georreferenciadas

Georeferenced coordinates

Official coordinate data used to define the precise position and shape of land or a building on a mapped reference system.

Why this matters

They can be required to coordinate the Cadastre and Land Registry or register certain building and boundary changes. A surveyor may be needed.

Cuota de Participación

Participation quota

The percentage allocated to a property within a community of owners, generally used to determine voting rights and the owner’s share of common expenses.

Why this matters

A large quota can mean a larger share of ordinary charges and extraordinary assessments, unless the statutes validly provide otherwise.

D

Declaración de Obra Nueva

Declaration of new construction

A notarised declaration used to record a completed or under-construction building, extension or other qualifying works in the Land Registry.

Why this matters

A physical building can exist without being correctly recorded. Registration requires supporting planning and technical documents appropriate to the case.

Derrama

Extraordinary community assessment

An additional contribution approved by a community of owners to pay for exceptional works or costs not covered by the ordinary budget.

Why this matters

Clarify all approved and expected assessments and state in the purchase contract whether the buyer or seller will pay each instalment.

División Horizontal

Horizontal division deed

The legal document dividing a building or development into separate private properties and communal elements, usually assigning descriptions and participation quotas.

Why this matters

It helps establish exactly what is private, communal or for exclusive use and can reveal restrictions affecting extensions, terraces, parking and storage.

Due Diligence

Legal and technical checks

The investigation carried out before purchase into ownership, debts, planning, licences, taxes, community matters, contracts and the physical condition of the property.

Why this matters

A viewing and a Nota Simple alone are not a complete legal and technical investigation. The scope should match the property and intended use.

E

Escritura Pública

Public title deed

The notarised public deed used to formalise the transfer of ownership. It identifies the parties, property, price and relevant legal declarations.

Why this matters

Signing the deed is the completion moment in most purchases, but registration and tax filings still need to be completed afterwards.

Estatutos de la Comunidad

Community statutes

The registered rules governing the organisation, rights and obligations of owners within a community. Additional internal rules may regulate day-to-day use.

Why this matters

Statutes and valid community decisions may restrict alterations, signs, pets, business activity or tourist rentals. Review them before relying on an intended use.

F

Fianza

Rental security deposit

The statutory security deposit paid by a tenant under a rental agreement. Additional guarantees may also be agreed within the limits of applicable law.

Why this matters

The statutory deposit normally has to be lodged with the competent regional authority. This is separate from rent paid in advance or other guarantees.

Finca Registral

Registered property unit

The unique property unit recorded at the Land Registry, with its own registry number and legal description.

Why this matters

The registered unit must match what you believe you are buying, including parking spaces, storage rooms, land and annexes.

G

Gastos de Comunidad

Community fees

Regular amounts paid by owners toward the shared expenses of a building or development, based on the budget and applicable participation rules.

Why this matters

Request the current amount, payment frequency, recent accounts and information about arrears or planned increases.

H

Hipoteca

Mortgage

A loan secured against real estate and recorded at the Land Registry. If the borrower defaults, the lender may enforce the security under the applicable procedure.

Why this matters

Mortgage approval is separate from agreeing to buy. Finance conditions, valuation, costs, timing and consequences of refusal should be addressed before paying a non-refundable deposit.

I

IBI

Impuesto sobre Bienes Inmuebles

The annual municipal property tax, generally calculated using the cadastral value. The registered owner is responsible under the applicable tax rules.

Why this matters

Request recent IBI receipts and confirm there are no unpaid amounts, as property-related tax debts can create problems for a buyer.

IRNR

Impuesto sobre la Renta de no Residentes

Spanish non-resident income tax. Non-resident owners may have filing obligations connected with rental income or the imputed income attributed to property kept for personal use.

Why this matters

Owning a Spanish home can create annual Spanish tax filings even when it is not rented. Obtain personal tax advice and diarise the deadlines.

ITE / IEE

Building inspection / evaluation report

A periodic technical inspection or building evaluation that may be required for older buildings, depending on regional and municipal rules.

Why this matters

An adverse report or pending remedial work can lead to significant future costs for the community of owners.

ITP

Impuesto sobre Transmisiones Patrimoniales

Transfer tax generally paid by the buyer on a resale property. The applicable rules, taxable base and rate are set by the relevant autonomous community.

Why this matters

The taxable amount is not always simply the agreed price. Obtain current advice for Andalusia and your specific transaction.

IVA

Impuesto sobre el Valor Añadido

Spanish value-added tax. It commonly applies to the first sale of a new home by a developer instead of ITP, together with other potential taxes and costs.

Why this matters

New-build and resale purchases have different tax structures. Your budget should identify IVA, AJD and all other purchase costs separately.

L

LAU

Ley de Arrendamientos Urbanos

Spain’s Urban Leases Act, which regulates many residential and commercial rental agreements. The rules differ according to the type and date of the contract.

Why this matters

Contract wording cannot always override mandatory tenant or landlord protections. Current legal advice matters when renting or letting.

Licencia de Obra

Building permit

Municipal authorisation for building, extension or renovation works. The type of licence or prior declaration required depends on the works and local rules.

Why this matters

Unlicensed works can cause fines, registration problems and difficulties with finance, insurance or resale.

Linderos

Property boundaries

The recorded or physical boundaries separating a property from neighbouring land, roads or communal areas.

Why this matters

Fences and occupation on the ground do not always match the deed, Registry or Cadastre. Material discrepancies require legal and technical investigation.

LPO

Licencia de Primera Ocupación

The municipal first-occupation authorisation or equivalent control confirming that a completed building may be occupied in accordance with the applicable procedure.

Why this matters

Its absence can affect occupation, utilities, mortgages, holiday-rental use and resale. Requirements vary with the property’s age and municipality.

M

Memoria de Calidades

Building specification

The written specification describing materials, finishes, installations and equipment promised for a new-build property.

Why this matters

Treat it as a contractual document. Check substitution clauses and compare the finished property against it during snagging and handover.

Modelo 210

Non-resident tax return form

The Spanish tax form commonly used by non-residents to declare certain Spanish-source income, including property rental income, imputed property income or some gains.

Why this matters

The relevant filing period and calculation depend on the type of income and the owner’s circumstances. A gestor or tax adviser should confirm the correct treatment.

N

NIE

Número de Identidad de Extranjero

The identification number assigned to a foreigner for official and financial dealings in Spain. Foreign buyers normally need one to complete a property purchase and pay taxes.

Why this matters

An NIE is an identification number, not proof of residence or tax residence. Apply early because processing times can vary.

Nota Simple

Land Registry extract

An informative Land Registry extract showing the registered description, owners and many registered charges or restrictions at the date of issue.

Why this matters

It is essential but not a complete due-diligence report. Use a recent copy and have discrepancies or unfamiliar entries explained.

Notario

Notary

A public official who verifies identity, capacity and legality when the public deed is signed and gives the deed public authenticity.

Why this matters

The notary is impartial and does not carry out the buyer’s full legal investigation or act solely for either party.

Número de Referencia Catastral

Cadastral reference number

The official alphanumeric identifier used to locate a property in the Spanish Cadastre.

Why this matters

Check that the cadastral reference in contracts, tax records and the deed refers to the correct property and included elements.

P

PGOU

Plan General de Ordenación Urbanística

A municipality’s general urban planning instrument, or its applicable successor under current regional planning law, setting broad land classifications and development rules.

Why this matters

Planning designation affects permitted use, building rights and future development. Current municipal planning information must be checked for the specific plot.

Plusvalía Municipal

Municipal land value increase tax

A municipal tax connected with the transfer of urban land, calculated under statutory rules. In a normal sale it is generally the seller’s responsibility, subject to the circumstances.

Why this matters

The contract should state who handles and pays it, while the buyer’s lawyer should still ensure the transaction is correctly completed.

Poder Notarial

Power of attorney

A notarised document authorising another person, often a lawyer, to act on specified matters such as obtaining an NIE, signing contracts or completing a purchase.

Why this matters

Powers should be no broader than necessary. Check the exact authority, duration and revocation arrangements before signing.

Promotor

Property developer

The person or company promoting a construction or development project and arranging its planning, financing, construction and sale.

Why this matters

For an off-plan purchase, investigate the developer, land ownership, permits, funding, guarantees, specification and completion arrangements.

Propiedad Horizontal

Condominium or apartment ownership regime

The legal regime combining private ownership of an individual unit with co-ownership of common elements in a building or development.

Why this matters

Ownership includes obligations to the community as well as rights over the private unit. The title, statutes and community decisions all matter.

R

Registro de la Propiedad

Land Registry

The public registry recording ownership and registered rights or charges over property. Registration provides important legal protection after completion.

Why this matters

After signing, ensure the deed is submitted, taxes are filed and ownership is correctly registered in your name.

Reserva

Reservation agreement

An agreement, often with a reservation payment, intended to take a property off the market while the next steps are prepared. Terms vary widely.

Why this matters

Confirm who holds the money, when it is refundable, what checks are allowed and what happens if finance or legal review is unsatisfactory.

Retención del 3%

3% non-resident seller withholding

When the seller is non-resident for Spanish tax purposes, the buyer is generally required to withhold 3% of the agreed price and pay it to the Spanish tax authority on account of the seller’s potential capital-gains tax.

Why this matters

The buyer has a filing and payment obligation with a deadline. The withholding is not an extra discount or automatically the seller’s final tax bill.

S

Servidumbre

Easement

A legal right or burden allowing use of, access over or restrictions upon another property, for example a right of way, drainage or utility access.

Why this matters

An easement can materially affect privacy, access, building possibilities and maintenance. Check both registered entries and visible conditions on site.

Snagging List

Lista de repasos

A detailed list of defects, unfinished items or deviations identified before or around handover of a new-build property.

Why this matters

Use an independent technical inspector where appropriate, document issues clearly and understand the procedure and deadlines for correction.

Subrogación Hipotecaria

Mortgage subrogation

A legal change involving an existing mortgage, such as changing lender or, in some transactions, a buyer taking over a developer’s or seller’s loan position subject to approval.

Why this matters

Never assume taking over an existing mortgage is automatic or advantageous. Compare the conditions, fees, liability and alternatives independently.

Suelo Rústico

Rural land

Land classified under planning law as rural or non-developable, with uses and building rights that may be substantially restricted.

Why this matters

Do not assume a house, extension, pool or future project is permitted merely because it physically exists on the land. Specialist planning checks are essential.

Superficie Construida

Built area

The constructed floor area measured using the applicable criteria and often including walls and, in some descriptions, a share of communal elements.

Why this matters

It is not the same as usable internal area. Ask exactly which measurement is advertised and compare the deed, Cadastre, Registry and survey.

Superficie Útil

Usable floor area

The floor area that can actually be used inside a property, generally excluding the footprint of structural and enclosing elements under the applicable measurement method.

Why this matters

Usable area is normally smaller than built area and can be more meaningful when comparing the practical size of homes.

T

Tasa de Basura

Municipal waste charge

A local charge for waste collection or treatment. The amount and billing method depend on the municipality.

Why this matters

Check whether it is billed separately from IBI and whether any outstanding amounts exist.

Tasación

Valuation

A professional assessment of a property’s value. A lender usually commissions or requires an approved valuation when considering a mortgage.

Why this matters

The mortgage is often linked to the lower of the purchase price or assessed value, so a low valuation can increase the cash you need.

U

Usufructo

Usufruct

A right allowing one person to use and benefit from property owned by another person, subject to the terms and duration of that right.

Why this matters

A registered usufruct can prevent a bare owner from giving vacant possession or full use alone. All necessary right holders may need to participate in a sale.

V

Valor Catastral

Cadastral value

An administrative value assigned by the Cadastre and used as a basis for several property-related taxes and charges. It is not the same as the market price.

Why this matters

It affects recurring and transaction-related calculations but should not be treated as an independent valuation of what the property is worth.

Valor de Referencia

Cadastral reference value

A value determined by the Cadastre that can form the minimum taxable base for certain property transfer and inheritance taxes, subject to the applicable rules and challenge procedures.

Why this matters

Tax may be calculated on a value higher than the agreed purchase price. Check the current reference value and obtain advice before completion.

Vicios Ocultos

Hidden defects

Serious defects that were not apparent on ordinary inspection and may give rise to remedies if the legal requirements and deadlines are met.

Why this matters

Legal remedies can be narrow and time-sensitive. A pre-purchase technical survey is safer than relying on a later hidden-defects claim.

VPO

Vivienda de Protección Oficial

Officially protected housing subject to public-law conditions that may restrict eligibility, sale price, rental or transfer for a defined period.

Why this matters

A VPO property cannot always be bought, sold or used like an unrestricted home. Verify its status and remaining restrictions.

VUT

Vivienda de Uso Turístico

A dwelling offered for short-term tourist accommodation and subject to tourism, planning, community and registration requirements. In Andalusia, eligibility and operating conditions must be checked before advertising or renting.

Why this matters

A previous registration does not guarantee that your intended use remains permitted after purchase. Check municipal planning rules, community restrictions and current regional and national registration requirements.

Z

Zona Común

Communal area

An element owned or used collectively within a building or development, such as gardens, pools, roofs, façades, lifts or access ways.

Why this matters

Exclusive use does not necessarily mean private ownership. Confirm boundaries, maintenance duties and permitted alterations.
