Reduced Property Tax Rates in Andalucía

Some buyers can qualify for a lower ITP or AJD rate when purchasing a habitual home in Andalucía. See the principal categories, value limits and conditions before you budget the saving.

The general Andalusian ITP rate for many property transfers is currently 7%. Reduced rates are exceptions and should be confirmed before completion.

Which Tax Applies to Your Purchase?

Reduced rates depend first on the type of transaction. A resale purchase commonly attracts ITP, while a developer’s first transfer normally attracts IVA and AJD.

This page explains the principal reduced ITP and AJD rates available under Andalusian rules. It does not mean every buyer or every property qualifies.

Start with the transaction, not the buyer

Before checking age, family or disability conditions, your lawyer must establish whether the purchase falls under ITP or IVA and AJD.

Who May Qualify for Reduced ITP?

The table summarises the main property-related categories. The qualifying value is determined under tax rules and may not simply equal the advertised price.

“Does not exceed” means the threshold itself may qualify. Confirm how joint purchasers and the applicable taxable value affect your case.

What Counts as a Habitual Home?

Residential property intended as a permanent home in Andalucía

A reduced rate based on habitual-home use is intended for a genuine main residence—not automatically for a holiday home, occasional residence or buy-to-let investment.

Occupation and continuity matter

The habitual-home concept follows statutory requirements. As a general rule, and except where a recognised exceptional circumstance applies, the buyer must live in the property as their habitual home and maintain that status for at least three years.

Residency administration is not enough on its own

Registration at an address can be relevant evidence, but the complete factual and legal position determines whether the condition is met.

Taxable value

The €150,000 or €250,000 Limit

A buyer can fit the personal category but still fail the reduced-rate test because the property exceeds the statutory value limit.

 

Purchase Price

The consideration recorded in the deed is an important part of the tax position.

A higher official cadastral reference value can affect the taxable value and eligibility for the threshold.

 

Confirm Before Signing

Ask your lawyer to confirm both the tax base and the reduced-rate value test in writing.

A low agreed price does not guarantee the lower rate

If the applicable tax value exceeds the threshold, budgeting the reduced percentage may leave a significant shortfall.

The €240,000 example is relevant only to a qualifying category with the €250,000 threshold. It does not fit the €150,000 categories.

New-build transactions

Reduced AJD Rates in Andalucía

Where a purchase is subject to IVA and AJD rather than ITP, reduced AJD rates may apply under comparable habitual-home categories.

     

The general Andalusian AJD rate is currently 1.2%. IVA remains a separate tax; a reduced AJD rate does not remove the applicable IVA.

Not always all-or-nothing

What If There Are Several Buyers?

Joint purchasers do not always share the same age, disability status or other qualifying circumstances. The effect on the tax rate can depend on the wording of the relief, each buyer’s ownership share and the complete household position.

Do not assume one qualifying buyer automatically gives the lower rate to every purchaser, or that adding another owner has no impact.

Decide ownership with legal advice

Ownership percentages have long-term legal, inheritance and tax consequences. They should not be chosen solely to pursue a lower purchase-tax rate.

Disability Certificate

Official recognition showing the legally required degree of disability.

A valid official large-family certificate covering the relevant acquisition date.

 

Protected Victim Status

The specific official documentation required by the statutory category.

 

Municipality Confirmation

Verification that the location appears on the official depopulation list for that year.

 

Purchase Deed and Ownership

The buyer details, shares, intended use and declarations recorded correctly.

 

Reference Value

The applicable valor de referencia checked for the completion date.

If circumstances change

What Happens If You Later Lose the Benefit?

If a reduced rate was claimed but its requirements are not ultimately satisfied, the unpaid difference does not simply disappear.

The buyer may need to submit a supplementary self-assessment and pay the additional tax, potentially together with interest or other charges under the rules then applying.

Example: selling too soon

If the property is sold before it has qualified as the habitual home for the required period, the relief may be lost unless a legally recognised exceptional circumstance applies.

Frequently asked questions

Reduced Rates Explained

 
Does every buyer under 35 pay 3.5% ITP?

No. The property must normally become the buyer’s habitual home, the buyer must meet the age condition and the applicable property value must not exceed €150,000.

 
Can I use the reduced rate for a holiday home?

The principal reduced rates described here require habitual-home use. A holiday or investment property will not normally meet that condition.

 
Is the limit based only on the purchase price?

Not necessarily. The applicable taxable value, including the effect of a valor de referencia, must be checked.

 
Can a non-Spanish buyer qualify?

Nationality alone is not the determining factor. The buyer must genuinely meet the exact personal, property-value and habitual-home requirements.

 
Do large families use the €150,000 limit?

The principal Andalusian 3.5% ITP relief for a qualifying large family currently has a €250,000 property-value limit and requires habitual-home use by that family.

 
Does a 3.5% ITP rate mean I also pay 3.5% AJD?

No. ITP and AJD apply to different transaction types and have separate rates. Your lawyer must first identify which taxes apply.

 
What if I move within three years?

The benefit may be lost unless a legally accepted exceptional circumstance applies. Obtain advice before moving, selling or changing the property’s use.
